Overview
Julius Matusewicz is an associate in the firm’s Litigation and Dispute Resolution Practice Group. His practice primarily focuses on representing insurers throughout first-party property insurance claims and disputes, handling pre-suit investigations and coverage determinations, as well as all aspects of litigation, including trial. He has also represented insurers in bad faith litigation, investigations of fraudulent claims, as well as extra-contractual disputes.
Julius is also experienced in assisting clients with cyber losses and other cybersecurity related matters, including risk assessment and incident response. He has further assisted insurers in claims of cryptocurrency theft, having prepared coverage opinions and handled pre-suit investigations for such losses.
Earlier in his career, Julius worked at the State Attorney’s Office in Pinellas County, Florida, handling hundreds of cases and numerous trials, both jury and non-jury.
Julius’s parents both emigrated from Poland, making him a second-generation American. Originally from New York, he has spent the majority of his life in the Tampa Bay area. Julius is fluent in Polish, and has a professional working proficiency in both Spanish and French.
Representative Matters
- Obtained dismissals (with prejudice) of first-party breach of contract claims against insurers based on successful misrepresentation and fraud defenses
- Prevailed on summary judgment in favor of insurer in claims for breach of contract and declaratory relief
- Secured abatement of insureds’ breach of contract lawsuit to allow insurer to invoke its right to repair claimed losses
- Obtained insureds’ withdrawal of claims during pre-suit investigation following admission of fraud
- Prevailed at jury trial in favor of insurer on breach of contract claims
- Defended insurers in hundreds of depositions relating to specific involvement of field and desk adjusters, claims managers, and corporate representatives in claims adjustment and internal claims handling procedures
- Took hundreds of depositions of policy holders, public adjusters, and related non-party and expert witnesses for trial, including pre-suit Examinations Under Oath on behalf of insurer
- Secured several ex-parte orders in favor of insurer for discovery violations in breach of contract lawsuits
- Represented insurer throughout receivership process transition involving the Florida Department of Financial Services and the Florida Insurance Guaranty Association
- Prepared coverage opinion for insurer relating to claim for cryptocurrency theft
