Jessica West was quoted in a Bloomberg Law article on March 21, 2022 discussing the ongoing debate around the federal vaccine mandate for health-care workers, which the U.S. Supreme Court upheld earlier this year.
The mandate, issued by the Centers for Medicare & Medicaid Services (CMS) requires healthcare workers at providers paid by Medicare and Medicaid to be fully vaccinated, and despite the Supreme Court’s ruling, the rule has been faced with opposition, especially as the Biden administration begins softening its pandemic response in other areas. While opponents argue that the mandate is no longer necessary as the Omicron surge subsides, CMS has said the rule isn’t tied to the public health emergency.
While litigation on the matter continues, West noted that the impact of the litigation on current employers is “a little bit more moot,” since those who needed to get vaccinated likely already have.
